You agree to use the App in compliance with all applicable local, state, and federal laws and regulations. TCC prohibits unlawful use of its mobile application. Unlawful use includes, but is not limited to, any of the following behavior, on your own behalf or on behalf of others:
Except as otherwise provided herein, the App is owned by the Rio Nuevo Multipurpose Facilities District, an Arizona tax levying special facilities district (District). The App is designed to provide information and services related to the Tucson Convention Center, including event schedules, ticketing information, maps, wayfinding, and more. District reserves the right to update, modify, or discontinue the App at any time without notice. District may modify or update these Terms and Conditions at any time.
District owns the Tucson Convention Center (TCC). TCC is leased from the District by the City of Tucson and is operated by ASM Global. The LightPlay aspect of the App is owned separately by Rypplzz, Inc. These Terms and Conditions apply to your use of LightPlay through the App unless specifically stated otherwise in this document. References in this document to “We” or “Our” refer to the District and its Licensees.
The Mobile App including its Content is intellectual property (IP) belonging to District. "Content" means the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, communications, interactive features, works of authorship of any kind, and information or other materials that are generated, provided, or otherwise made available through the TCC Mobile Application. The App including all Content is protected by all applicable IP laws including copyright laws. You may not use, reproduce, or distribute any Content from the App without District’s prior written permission.
Your use of the App is subject to your compliance with and agreement to these Terms and Conditions. These Terms and Conditions are material and essential to your use of the App. In consideration of your agreement and compliance to these Terms and Conditions, we grant you a limited license to download, view, display, and use the App solely for your personal use. The license is noncommercial, nonexclusive, non-transferable, non-sublicensable, and revocable without notice to you.
To the extent allowed by law, the TCC Mobile App including Content is provided for your use "AS IS” without any warranty of any kind. The App may contain links to third party websites or resources. We provide these links only as a convenience to you. We are not responsible for the content, products, or services on or available from third party websites or resources, or for any links displayed on such websites.
Some features of the App will require you to create a user account (Account). You are responsible for maintaining the security and confidentiality of your Account credentials and you are solely responsible for all activities that occur under your Account.
You may use the App only in compliance with all applicable local, state, and federal laws, and as authorized by these Terms and Conditions. Unlawful or unauthorized use of the App is prohibited, and includes (but is not limited to):
By using the App you agree that you will not, at any time while using the App and services provided through it, harass, threaten or otherwise violate the legal rights of others. You will not trespass, or in any manner attempt to gain or gain access to any property or location where you do not have a right or permission to be. You will not engage in any activity that may result in injury, death, property damage, nuisance, or liability of any kind.
If you have a dispute relating to your use of the App or services, including any services provided by third parties, you hereby release District, its officers, directors, agents, subsidiaries, joint ventures, employees, and Licensees from all claims, demands, causes of action, damages, losses, expenses or liability which may arise out of, result from, or relate in any way to such disputes. You also agree to hold harmless the District, its officers, directors, agents, subsidiaries, joint ventures, employees, and Licensees from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
The TCC Mobile App is not intended for use by children under the age of 13. We do not knowingly permit any such use, nor do we knowingly collect any personal information or data from children under the age of 13. If you believe we have collected such information please contact us and we will promptly delete it.
By using the App, you are necessarily providing information to District and its Licensees. We do not sell any such personal information about you. District’s Licensees may, however, collect and use your personal information and other data about you to track and analyze overall usage of the App and to make necessary changes and improvements to the App. You may find the full Privacy Policy of District’s Licensees at this link.
These Terms and Conditions are governed by and construed in accordance with the laws of the state of Arizona. By using the TCC Mobile App, you acknowledge that you have read, you understand, and you agree to these Terms and Conditions.
